1. Seller

2. Prices
Prices are shown in euros, without VAT (art. 293 B of the French General Tax Code). The price that applies is the one displayed at the time of the order; we may change it at any time for future orders (supplier prices, exchange rates, etc.). Delivery costs, and any insurance costs, are shown before you confirm your order.
For shipments outside the European Union, customs duties, taxes or clearance fees may be charged by the destination country or by the carrier when the parcel is received. They are not included in our prices, they are payable by the buyer, and we have no knowledge of them: we advise you to check with your country’s customs authorities before ordering.
A quote can be provided on simple request, by internet or by telephone.
3. Orders
Orders are placed on the website or by telephone, Monday to Friday. By confirming your order, you acknowledge that you have read and accepted these terms of sale as well as our terms of use. We confirm your order by e-mail. As products are often available as a single item (in particular used parts), if an item is no longer available after your order, we will let you know and refund you without delay.
4. Payment
Payment of the total amount (products and delivery) is made when ordering, by bank card via PayPal or by bank transfer. The order is shipped only once payment has actually been received.
5. Delivery
Lead times: for items in stock, orders placed before noon, Monday to Friday, are shipped within 48 hours. In busy periods, this can take up to one week. In urgent cases, express shipping is possible for an additional shipping fee. Unless otherwise agreed, delivery takes place no later than 30 days after the order.
Place: to the address of your choice, or to a pick-up point depending on the delivery method chosen.
Orders to the United States: orders for delivery to the United States cannot be placed directly on the website. Please contact us using the contact form or by e-mail (blandine@passion-atc.com), stating the items you want and your delivery address. We will prepare a quote including the actual transport costs and the estimated customs duties. The order is confirmed once you have accepted the quote and payment has been received.
Transport and reservations: check your parcel on delivery. If the parcel is damaged or opened, make precise reservations to the carrier and contact us as soon as possible so that we can find a solution. For consumers, the risk of loss or damage is ours until the parcel is handed over.
Insurance: parcel insurance may be offered depending on the delivery method and the value of the order; its cost is shown before you confirm your order.
6. Right of withdrawal (consumers)
If you are a consumer, you have 14 days from receipt of your order to withdraw, without having to give a reason or pay any penalty.
To exercise this right, inform us of your decision by e-mail or by post, stating your order. You may use the model form below, but this is not compulsory.
You must send the items back to us no later than 14 days after notifying us, in their original packaging, complete and in good condition, with the invoice. Return costs are at your expense. We do not accept parcels sent carriage forward or cash on delivery.
We refund all sums paid, including standard delivery costs, no later than 14 days after being informed of your decision, using the same means of payment as for the order. We may defer the refund until we have received the items or until proof of their dispatch has been provided.
You are liable only for any loss in value of the product resulting from handling other than what is necessary to check its nature and proper functioning. A part that has been fitted, used or damaged may give rise to a deduction.
7. Exchanges, take-backs and returns (business customers)
For business customers, the right of withdrawal does not apply. For a problem of size, colour or fitment (excluding clearance or promotional items), we may accept an exchange within 10 days of receipt, after prior agreement, with the item in its original packaging with the invoice, return shipping at your expense. If we cannot replace it, we will offer you an equivalent model or a credit note. Any take-back of equipment is made with our agreement, with a 10% deduction. After this period, items are no longer taken back or exchanged.
8. Warranties
Legal guarantee of conformity: for consumers, we are liable for lack of conformity existing at the time of delivery, for 2 years for new products and 12 months for used products, in accordance with Articles L217-3 et seq. of the French Consumer Code. You may request repair or replacement of the product and then, failing that, a price reduction or cancellation of the sale.
Guarantee against hidden defects: it applies under Articles 1641 et seq. of the French Civil Code.
Manufacturers’ commercial warranty: new products may benefit from their manufacturer’s warranty, in addition to the legal guarantees. For business customers, the warranty is limited to replacement of the product recognised by us as defective.
Used parts: they are described to the best of our knowledge. Contact us before purchase with any question about their condition or compatibility.
Exclusion: we cannot be held liable for damage resulting from installation that does not follow the manufacturer’s recommendations, poor fitment or faulty use of the product (see our Terms of use). This exclusion does not limit consumers’ statutory rights.
9. Applicable law and disputes
This contract is governed by French law and is drafted in French. In the event of a dispute, we invite you to contact us first to seek an amicable solution. Failing that, the competent courts are those of the company’s registered office for business customers; for consumers, the statutory rules of jurisdiction apply.
